Please read these terms carefully before using this website or booking your stay at The Blue Sea Star.
1. Agreement & Acceptance
Your use of the website theblueseastar.com ("Site") constitutes your agreement to all Terms and Conditions set forth herein. If you do not agree, please do not use this Site or make a reservation. These Terms govern your use of the Site and supplement the rental agreement ("Rental Agreement") that you sign when booking the property known as The Blue Sea Star ("the Property"), located at 1310 Surf Dr, Freeport, TX 77541.
By submitting a reservation through this Site or any linked booking platform, you ("Guest") acknowledge that you have read, understood, and agree to be bound by these Terms and the house rules. The Property is owned and managed by Beach Paradise Properties, LLC ("Owner").
Additional terms regarding payment, security deposits, occupancy, property care, liability, indemnification, and termination are governed by the Rental Agreement signed at the time of booking. In the event of any conflict between these Terms and the Rental Agreement, the Rental Agreement shall control.
2. Electronic Communications
By using this Site or sending emails to us, you consent to receiving electronic communications from Beach Paradise Properties, LLC. These communications may include booking confirmations, check-in instructions, policy updates, and post-stay correspondence. You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing.
3. Cancellation Policy
- More than 30 days before arrival: 100% refund of total booking charges.
- More than 7 days before arrival: 50% refund of total booking charges.
- Within 7 days of arrival: No refund will be issued.
- No-shows: No refund will be issued for no-shows or early departures.
All cancellation requests must be submitted in writing via email to beach.paradise.properties@gmail.com. The cancellation date is the date the written notice is received. Travel insurance, damage protection, and any processing or administrative fees are non-refundable.
4. Hurricane, Force Majeure & Unforeseen Events
In the event of a mandatory evacuation order issued by local, state, or federal authorities for the Surfside Beach or Brazoria County area during your reservation dates, the Guest will receive a full refund for any unused nights or, at the Guest's option, may reschedule to alternative dates subject to availability.
Voluntary evacuations, tropical storm watches or warnings, weather advisories, or unfavorable weather conditions that do not result in a mandatory evacuation order do not qualify for a refund.
Neither party shall be liable for failure to perform obligations under these Terms due to events beyond their reasonable control, including but not limited to natural disasters, pandemics, government-imposed restrictions, acts of war or terrorism, utility failures, or road closures. In such cases, the Owner will work in good faith with the Guest to reschedule or provide a credit for future use. We strongly recommend purchasing third-party travel insurance.
5. Check-in & Check-out
- Check-in:4:00 PM – 10:00 PM. Self check-in is available via smart lock. Access instructions will be provided prior to arrival.
- Check-out: 11:00 AM. All personal belongings must be removed by checkout time.
- Late check-out: A fee of $50 per 30 minutes will be charged for late departures. Late check-out delays cleaning and preparation for incoming guests and may not be accommodated.
- Any check-in or check-out times outside of the standard times listed above must be agreed upon in writing by the Owner prior to arrival.
6. Quiet Hours
Quiet hours are observed from 10:00 PM to 8:00 AM. Guests must maintain reasonable noise levels at all times in consideration of neighboring properties. Excessive noise, unauthorized parties, or events that disturb neighbors may result in termination of the reservation without refund.
7. Smoking Policy
Smoking of any kind (including cigarettes, e-cigarettes, vaping devices, cigars, and marijuana) is strictly prohibited inside the Property, on all decks, balconies, and covered outdoor areas. A cleaning and restoration fee of $250 minimum will be charged to the Guest if evidence of smoking is detected. Additional charges may apply if specialized cleaning (e.g., ozone treatment, paint, or upholstery replacement) is required.
8. Pet Policy
- Up to 2 pets under 25 lbs each are permitted with prior approval. All pets must be disclosed at the time of booking.
- Pets must not be left unattended in the Property unless crated. Pets are not permitted on furniture or beds.
- The Guest is fully responsible for any damage caused by their pet(s), including but not limited to scratches, stains, odors, and furniture damage.
- Undisclosed or unauthorized pets: A fee of $50 per animal per stay will be charged, in addition to any damage repair costs.
- Guests must clean up after their pets on all Property grounds and neighboring areas.
9. Parking
Free parking is available in the designated driveway and parking areas only. Recreational vehicles, trailers, and boats may not be parked on the Property without prior written approval. Guests shall not park on neighboring properties, landscaped areas, or in any manner that blocks access. The Owner is not responsible for theft, damage, or loss to vehicles or their contents while parked at the Property.
10. Security & Surveillance Disclosure
The Property may be equipped with exterior security cameras and/or a doorbell camera for safety and security purposes. These devices are positioned to monitor exterior entry points and common outdoor areas only. There are no cameras or recording devices inside the Property or in any private areas. By booking, the Guest acknowledges and consents to the presence of exterior surveillance devices.
11. Local Laws & Regulations
Guests are expected to comply with all applicable local, state, and federal laws during their stay, including but not limited to:
- No glass containers on the beach— this is a Surfside Beach municipal ordinance.
- No fireworks— fireworks are prohibited within the Village of Surfside Beach.
- Sand dune protection— do not walk on, dig in, or disturb sand dunes. They are protected under Texas law.
- Vehicle beach access— follow all posted signs and speed limits on the beach. A current beach parking permit may be required.
- Violation of any law or ordinance that results in fines, penalties, or damage to the Property will be the sole responsibility of the Guest.
12. Intellectual Property & Site Use
All content on this Site — including text, photographs, graphics, logos, icons, and design — is the property of Beach Paradise Properties, LLC and is protected by applicable copyright and trademark laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes only.
You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit any material from this Site without prior written consent, except as incidental to normal web browsing. You may not use the Site in any manner that could damage, disable, overburden, or impair the Site or interfere with any other party's use.
13. Third-Party Links & Services
This Site may contain links to third-party websites or services (including booking platforms and payment processors) that are not owned or controlled by Beach Paradise Properties, LLC. The Owner assumes no responsibility for the content, privacy policies, or practices of any third-party sites. You acknowledge and agree that the Owner shall not be liable for any damage or loss caused by your use of or reliance on any third-party content, products, or services.
14. Disclaimer of Warranties
This Site and all information, content, materials, and services provided through it are offered on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, Beach Paradise Properties, LLC disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Owner does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components, or that any information on the Site is accurate or complete.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Beach Paradise Properties, LLC and its members, officers, agents, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the Site or these Terms. In no event shall the Owner's total liability exceed the amount paid by the Guest for the applicable reservation.
16. Privacy & Guest Information
Personal information collected during the booking process (name, email, phone number, payment details) is used solely for the purpose of managing your reservation, communicating with you about your stay, and complying with legal requirements. We do not sell or share your personal information with third parties for marketing purposes without your consent. Payment processing is handled by secure third-party processors; the Owner does not store credit card information.
We may share your information with service providers who assist in operating the Property (e.g., cleaning services, maintenance providers) solely to the extent necessary to fulfill your reservation.
17. California Consumer Privacy Act (CCPA)
If you are a California resident, you may have additional rights under the California Consumer Privacy Act, including:
- The right to know what personal information is collected, used, and shared
- The right to request deletion of your personal information
- The right to opt out of the sale of personal information
- The right to non-discrimination for exercising your privacy rights

18. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.
In the event of any dispute arising from or related to these Terms or the Guest's use of the Site, the parties agree to first attempt resolution through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may pursue binding arbitration administered in Brazoria County, Texas, in accordance with the rules of the American Arbitration Association.
Class Action Waiver:Each party shall bear its own costs and attorney's fees unless the arbitrator determines otherwise. The parties agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. The parties waive any right to participate in a class action lawsuit or class-wide arbitration.
19. General Provisions
- Relationship to Rental Agreement: These Terms supplement the Rental Agreement signed at the time of booking. Together they constitute the complete agreement between the Guest and the Owner regarding use of the Site and rental of the Property.
- Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
- Modifications: The Owner reserves the right to update these Terms at any time. The Terms in effect at the time of booking will govern that reservation. We encourage you to review this page periodically.
- Waiver:The Owner's failure to enforce any provision of these Terms shall not constitute a waiver of that provision or the right to enforce it in the future.
- Assignment:The Guest may not assign or transfer their reservation or any rights under these Terms without the Owner's prior written consent.
